Child sex allegation

16 Mar, 2010 03:33 PM
A MORTDALE man, 31, will face Central Local Court on April 5 to answer four charges, including one of sexual intercourse with a child, after the case was adjourned on Thursday.

Trevor Essex is alleged to have had sexual intercourse with a person aged under 10, recklessly causing grievous bodily harm, failing to provide for a child, causing danger of serious injury, and hindering an investigation of a serious indictable offence.

All relate to incidents that allegedly took place in February last year.

He is also accused of neglecting a child in his care in November 2008 and faces three charges of contravening restrictions in an apprehended violence order in February 2009.

Driver disqualified

A DISQUALIFIED driver, 18, whose sports motorcycle was clocked at more than three times the speed limit was fined $200 and ordered to pay $76 in court costs.

Mathew James Harwood of Loftus was also disqualified from driving for a year.

Harwood was clocked at 148-159km/h in a 50km/h zone on December 8 last year and charged with two offences driving while suspended and driving recklessly at a dangerous speed.

Police officers in an unmarked police car were watching as the storeman packer turned from Spur Crescent into Loftus Avenue, Loftus, where he rapidly accelerated, despite being in a signposted 50km/h street.

Sutherland Local Court was told Harwood admitted he had been driving his Honda motorbike while disqualified.

Charges dismissed

A RUGBY league player who smashed a Cronulla home unit window and kicked a shopfront window while drunk had two charges relating to the February incidents dismissed.

Luke Michel Kemp, 24, of Coogee, appeared in Sutherland Local Court last Thursday, where he pleaded guilty to charges of recklessly damage and behaving offensively in a public place.

The electrician/wholesaler smashed the home unit window at Cronulla, while Shannon O'Meara and Paul Davis were inside watching television.

After the two heard heard the sound of glass shattering they chased and cornered Kemp outside, where he offered to pay for the damage but said he did not have his wallet with him.

Kemp and the two men went to collect the money from Cronulla's Sting Bar, where Kemp said his mates were waiting.

Mr O'Meara and Mr Davis told police that once there, Kemp became aggressive and Kemp's friend offered them $20, which they refused, before they were told to "f... off''.

A short time later, police who were walking along the Kingsway, Cronulla, saw Kemp kicking the shopfront window of Individual Eyewear, setting off the alarm.

Police said Kemp was "extremely intoxicated'' but had "suddenly snapped out of it'' at the police station, where he was charged.

Character references were presented to the court, including one which said Kemp was a "very good rugby league player'' who had spent a few years playing in England.

Magistrate Susan Duncombe said Kemp had expressed remorse for his actions and had offered to make restitution for the damaged window.

She said he was unlikely to re-offend and she hoped he had learnt his lesson.
