P-plater's dreaded day

20 Nov, 2009 04:55 PM
THE teenage driver involved in a fatal crash at Miranda last year will appear in Sydney District Court this Friday for the start of sentencing procedures.

Kristopher Hamilton, 15, of Gymea, was killed in the crash about 4.20am on October 18 last year.

The P-plate driver, who cannot be identified for legal reasons, also suffered head and internal injuries when the Holden Commodore hit a median strip, struck a tree, rolled, and came to a rest on its wheels.

He has pleaded guilty to dangerous driving causing death, not complying with P1 licence restrictions, not giving particulars to police and not disclosing a driver's identity.

Child attack charges

A TEMPE man has appeared in Kogarah Local Court on five charges of indecently assaulting a person under the age of 16.

The man, 41, cannot be named for legal reasons.

His lawyer asked that police present a brief of evidence by December 3 for reply the following week.

Magistrate Peter Bugden suggested that the brief may not be fully ready by December 3, but he agreed to mention the case again on that date.

The man's bail was continued.

Erection pill plea

AN ARNCLIFFE teenager has pleaded not guilty to using an unauthorised credit card to buy erection pills, hair-care products and body-building supplements.

Hussein Jaafar, 19, of Station Street, has been charged with 17 counts of obtaining money by deception.

The charges involve the unauthorised use of a credit card to buy a variety of products from a shop in Richmond.

The products included the sexual health products Wyld For Men, Super Sizzle and ErectOmax.

Body-building products named in the charges included Tibestanol Pro, Extreme-Cuts, Volumaize, No Xplode, True Mass, Muscletech, Mass Gainer Pro Xtreme, Hydroxycut, Cell Mass and Black Powder MRI Performance.

Mr Jaafar pleaded not guilty to all counts at Kogarah Local Court on Tuesday and will appear again on January 22.

Assault over falafel

A TURRELLA man who assaulted a man who owed him $50 has been described by a magistrate as a credit to the community and let off without conviction.

Frank Hijazi, 46, of Edward Street, who runs Hijazi Falafel in Wollongong Street at Arncliffe, appeared in Kogarah Local Court on Tuesday.

He had pleaded guilty to one count of assault in relation to a scuffle with one of his former customers who owed him money.

Hijazi's lawyer told magistrate Peter Bugden the victim had eaten at Mr Hijazi's restaurant 18 months ago and left without paying.

He said the man had been back to the shop regularly to taunt Hijazi, who lashed out when the pair had a chance meeting on October 1.

"You are a hard-working, tax-paying member of the community,'' Mr Bugden told Hijazi. "You are one of the people who give Lebanese people a good name in the community and it is a great shame people like you don't get more publicity.''

Mr Bugden imposed a 12-month good behaviour bond but did not record a conviction.
