A WOMAN agreed to have sex with a man accused of sexually assaulting her at the Ivy nightclub, George Street, Sydney, his lawyer told a court on Saturday.
Chris Corben, 30, of Lilli Pilli, is accused of sexually assaulting a 34-year-old woman in the bathroom of the nightclub at 2am on Friday.
His lawyer, Mitchell Cavanagh, told Parramatta Bail Court that the alleged incident took place for 30 minutes and was not forced. He told the court that the woman and Mr Corben were naked at the time.
``It would be difficult to detain another person while removing their clothes and one's own clothing,'' he said.
Magistrate George Zdenkowski noted that police prosecutors did not oppose bail and granted "very strict conditional bail'' of $10,000.
Mr Corben must surrender his passport and report to police daily.
He was ordered not to consume alcohol or enter a licensed premises and was forbidden to have any contact with his alleged victim.
"This is an extremely serious offence,'' Mr Zdenkowski said. "There are a number of issues. The primary concern is the participation of the victim.''
