The end of the case in Roger Rogerson and Glen McNamara murder trial

But he is not a murderer, his barrister Gabriel Wendler argued during his closing address to jury on Monday.

"Can you seriously see Mr McNamara executing Mr Gao – a man the same age as one of his daughters?" Mr Wendler asked.

"Can you see Mr McNamara enticing this man into this shed and then shooting him dead? For what reason? To run around Cronulla selling [drugs]?"

Mr McNamara and former detective Roger Rogerson are both charged with the murder of university student Jamie Gao inside a Sydney storage shed in May, 2014.

The prosecution has argued the pair planned to kill Mr Gao in order to fleece him of almost three kilograms of the drug ice.

But Mr Wendler argued there was never any plan to kill Mr Gao and that his death was an "unwanted dimension" to a plan of Mr Rogerson's to steal drugs.

"Common sense surely must dictate that something went wrong in that shed," Mr Wendler said.

He said it made no sense to "complicate the situation by murdering the supplier" if the plan was to steal drugs.

Mr Rogerson's case is that he had never met the deceased and that he entered unit 803 at Rent a Space Padstow, and saw an Asian male dead on the ground.

He said he believed Mr McNamara who told him Mr Gao had shot himself twice in the chest during a struggle.

Mr Wendler finished his closing address on Monday, marking the end of the case before the jury.

It is the Crown's case that Mr McNamara and Mr Rogerson planned to kill Mr Gao, dispose of his body and steal almost three kilograms of the drug ice.

Justice Geoffrey Bellew began summing up the case to the jury and explained their responsibilities.

"It is for you and you alone to determine what happened on May 20, 2014 at the Rent a Space premises in Padstow, he said."

"You and you alone determine what the verdicts in this case are to be – I pay no role in that whatsoever."

After Justice Bellew finishes his summing up the jury will retire to consider their verdict.
