The driver who hit and injured Glenn Wheeler has had her sentenced upheld.
Deborah Levy, 60, pleaded guilty in October to negligent driving occasioning grievous bodily harm and driving a vehicle under the influence of alcohol or other drugs.
In March she avoided jail and was instead given a seven-month suspended sentence for the negligent driving charge and a two-year good behaviour bond for driving under the influence.
She was also disqualified from driving for three years.
The Director of Public Prosecutions appealed the decision saying it was far too lenient.
On Monday Judge Andrew Scotting upheld the original sentence.
Ms Levy was arrested after her Mitsubishi Star Wagon cut a corner and collided with Mr Wheeler’s scooter at the corner of Woolooware Road and Caronia Avenue in Woolooware in January 2015.
He suffered serious head and leg injuries and was placed in an induced coma.
He has since undergone treatment and rehabilitation at St George Hospital and Liverpool Brain Injury Unit before returning home in December.
