Approval has finally been given for a Woolworths supermarket, liquor store and childcare centre next to the brick pit development at Kirrawee.
After three previous bids failed, an agreement was hammered out with Sutherland Shire Council at a conciliation conference in the Land and Environment Court.
The decision is sweet victory for Woolworths and Payce, the developer of the shopping centre component of South Village, who joined forces to fight for the project.
The Land and Environment Court upheld an appeal against Sydney South Planning Panel’s refusal of the development application for properties at 24-38 Flora Street.
The project includes demolition of existing structures and construction of mixed use commercial development including Woolworths supermarket, Dan Murphy’s liquor store, commercial tenancies and a 90-place child care centre.
A range of conditions was agreed to, including the applicant entering into a voluntary planning agreement with the council to upgrade the intersection of President Avenue and Oak Road “with a minimum disturbance to the remaining Sydney Turpentine Ironbark Forest community”.
The intersection of Oak Road and Flora Street will also be upgraded. Improvements at this intersection were previously announced as part of roadworks for the South Village development.
Woolworths has been working for four years to establish a supermarket in Flora Street to compete against Coles and Aldi in the South Village shopping centre.
The company’s first DA was rejected by the Joint Regional Planning Panel in 2014.
A revised DA followed, but was withdrawn before the council rejected it.
In an unusual twist, Payce, which is developing the shopping centre opposite, then joined forces with Woolworths in the third proposal, which was enlarged to include a childcare centre.
Payce bought properties, 24-38 Flora Street, on condition Woolworths would lease spaces for a supermarket and Dan Murphy’s liquor store.
