A proposed new childcare centre at Miranda has been scaled back in size after the initial plans were rejected by both Sutherland Shire Council and the Land and Environment Court.
Under new plans, the building would be one one storey, instead of two, with capacity for 104 children, instead of the 141 places initially proposed.
The site is at 1-7 View Street, on the corner of Wandella Road, a few hundred metres south of the Westfield shopping centre.
An extra property has been acquired by the developer for the revised plans.
A new development application (DA) was lodged with the council in the week before Christmas.
The new DA said reasons given by the Land and Environment Court for refusing an appeal against the council decision on the original application related to “the proposed form of the building which, in the opinion of the commissioner, did not respond appropriately to the residential character of the area, on account of the scale and apparent volume of the building”.
“The subject proposal has been amended to address the reasons for refusal,” the new DA said.
“Most notably, the scale of the development is markedly reduced when compared to the previous proposal in that the building is now single storey as opposed to a two storey structure.”
The DA said the “proposed amendments result in a development will a significantly reduced scale and building volume, and provided for a built form that is compatible with the single dwelling character of the locality”.
A resident, who was at the forefront in fighting the initial plans, was unaware of the new DA.
