The NSW Civil and Administrative Tribunal has set aside the judgement considering the irregularity of the election results in Mortdale Ward in last year’s Georges River Council elections.
An application, brought against Mortdale Ward councillors Con Hindi, Lou Konjarski and Warren Tegg by Greg Briscoe-Hough alleged there were errors in the contents of their nomination forms.
Mr Briscoe-Hough said his own nomination form was incorrectly rejected by officers of the Electoral Commission.
His application was dismissed by the Tribunal in February.
Following this, Mr Briscoe-Hough said that the Tribunal was improperly constituted as it only had two sitting members instead of the required three when the matter was heard.
He requested that the Tribunal refer the matter to the NSW Supreme Court.
The Tribunal declined and scrapped the judgement and will review the matter from scratch.
The matter has been set down for a directional hearing on April 20.
