The Land and Environment Court will consider next week whether the controversial $32 million Ozone apartment block development at Cronulla should go ahead.
A large group of residents from neighbouring buildings, The Cecil, Breeze, Belgrave and Mare Blu, are expected to voice their objections at a site inspection by the court on December 13, followed by a courtroom hearing the next day.
The court action was confirmed as an embarrassing photo became available of a “DA Approved” sticker on an advertising sign in front of the Ozone Street site.
The sticker was removed when the Sydney South Planning Panel deferred a decision on the development application (DA) on November 21.
Before the hearing, the developer lodged an appeal with the Land and Environment Court on the grounds of “deemed refusal”.
At least one representative of the panel will attend the hearing to explain the reasons for deferral.
The deferment was a major setback for the developer, who has been selling units off the plan, including the penthouse for a record $7.5 million,
