A subpoena will be served on a pathologist to produce a report on how Marnie Lee Cave died in late 2015.
The case was mentioned in Batemans Bay Local Court on May 27 after being adjourned from Bega Local Court on May 24 to allow time for the report to be produced.
On May 24, Director of Public Prosecutions solicitor Brett Diggins said the report was required to fully understand the cause of Ms Cave’s death.
Bega woman Rosemary Priscilla Mackie is accused of murdering 26-year-old Ms Cave in October 2015. She has not yet entered a plea.
The prosecution told Batemans Bay court he would have the pathologists report by “Monday or Tuesday (next week) at the latest”.
“Once that is received, the crown will be in a position to continue,” the prosecution said.
Magistrate Doug Dick urged the prosecution to issue a subpoena as a “safety net”.
Mackie’s solicitor said his client “advises us she has no memory of the event”.
He also said Mackie had advised she had no memory of a video interview with police on November 27, 2015.
“She has no memory of either of those two things,” the solicitor said.
“I am getting health records to see if she has cognitive issues or if it is because of the stress of the charge,” Mackie’s solicitor said.
“If memory doesn’t come back, it would become an issue for her to give instructions to lawyers and to follow the court process.”
Mr Dick set a committal hearing down for June 14 in Bega Local Court.
Campers found Ms Cave’s body under Mogareeka’s Hancocks Bridge, near Tathra, on October 14.
It was revealed Ms Cave suffered a broken clavicle and skull, and strangulation on the night of her murder.
Mackie was charged with murder and wounding with intent to cause grievous bodily harm after she was arrested on December 1, 2015.
