Business consultant Tim Storer has been elected in a special count to replace former Nick Xenophon Team colleague Skye Kakoschke-Moore in the Senate.
But Mr Storer will sit as an independent, having quit NXT last year.
The High Court found Ms Kakoschke-Moore, who stood down in November over her dual citizenship, was not eligible to replace herself despite having renounced her British ties.
The court also found Mr Storer should not be excluded from the special count, despite having quit the party.
On Friday, the court received the result of the special count conducted by the Australian Electoral Commission.
