Residents have lost a two-year battle to stop a childcare centre being built in View Street, Miranda.
Sutherland Shire Council and the Land and Environment Court rejected the initial plans for the facility at the corner of Wandella Road, between the Westfield shopping centre and President Avenue.
The developer subsequently scaled back the building, purchased an additional property and reduced the number of proposed places.
Residents remained opposed, expressing concerns over traffic, parking, noise and the safety of children.
Sutherland Shire Local Planning Panel unanimously approved the development application (DA) following a hearing just before Christmas.
A new panel was appointed after a technical blunder with an earlier approval decision.
Conditions attached to the approval included that no more than 97 children can occupy the centre at any time.
The initial application was for 140 places, and the applicant later reduced the number to 104.
To reduce noise, the operator will have to submit a Plan of Management to the council, proposing times children will play outdoors, and also keep a complaints register.
In its decision, the panel said it considered “the proposed development will be in the public interest because it is consistent with the objectives of the particular standard and the objectives for development within the zone in which the development is proposed to be carried out”.
“The panel considered the proposal was well designed and had satisfactorily addressed the likely impacts that will result from the use,” the decision read.
“The panel considered that the conditions of consent (with refinement) would ensure that amenity impacts would be minimised.”
